4 October 2018 - People and Power: Authority and Human Rights in Operation

This ADRA half-day workshop will be convened by Peter Tierney, barrister, who will speak on human rights issues with a particular focus on four cases he was involved with:

  1. State of New South Wales v. Riley [2003] NSWCA 208 (1 August 2003) (intentional torts of assault and false imprisonment by police – aggravated and exemplary damages)
  2. Monaghan v Australian Capital Territory (No 2) [2016] ACTSC 352 (30 November 2016) (Human Rights Act (ACT) and novel duty of care in bail processing)
  3. Yasmin v Attorney-General of the Commonwealth of Australia [2015] FCA 91 and [2015] FCAFC 145 (administrative law and prerogative of mercy)
  4. Jasmin v The Queen [2017] WASCA 122 (29 June 2017) (miscarriage of justice, statutory referral powers and directed acquittal)

Peter Tierney will also draw on the report from the Australian Human Rights Commission - An Age of Uncertainty. Attendees are encouraged to skim through this document prior to the workshop.
